Terms of Use

1. Agreement

You represent that you have the authority to enter into these Terms. If you use the Service on behalf of an organization, you represent that you are authorized to bind that organization.

2. The Service

Pima helps you plan and estimate home projects. Features may include on-device project data, measurements, product search, optional AI or imagery features, and account sign-in. We may modify, suspend, or discontinue any part of the Service with reasonable notice where practicable.

The Service is not a substitute for professional advice (for example, from architects, engineers, contractors, or financial or legal professionals). Estimates, measurements, tax or weather information, and similar outputs are for convenience only.

3. Eligibility

You must be old enough to enter a binding contract where you live and meet any minimum age required by Apple’s App Store terms. The Service is not intended for children under 13.

4. Accounts and sign-in

Some features may require an account (for example, Apple Sign In). You are responsible for activity under your account and for keeping your credentials secure. Notify us if you believe your account has been compromised.

5. Your content

You retain ownership of content you create in the Service (for example, projects, notes, and images you add). You grant us a limited license to host, process, and display that content only as needed to operate the Service and optional features you choose (such as sync or analysis), consistent with our Privacy Policy.

You represent that you have the rights to any content you submit and that it does not violate these Terms or applicable law.

6. Acceptable use

You agree not to:

• Use the Service unlawfully, to harm others, or to violate third-party rights
• Attempt to gain unauthorized access to our systems, other users’ data, or reverse engineer the Service except where applicable law allows
• Interfere with or overload the Service
• Use the Service to distribute malware, spam, or misleading information
• Circumvent technical limits, paywalls, or usage restrictions we set

7. Third-party services

The Service may link to or rely on third parties (for example, retailers, maps, AI providers, search APIs, or Apple services). Those third parties have their own terms and privacy practices. We are not responsible for third-party sites or services.

8. Our intellectual property

The Service, including its design, branding, and software, is owned by Pima LLC or its licensors. Except for the limited rights to use the Service as offered, these Terms do not grant you any ownership or license to our intellectual property.

9. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PIMA LLC AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), IF YOU HAVE NOT PAID US ANY FEES.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, OUR LIABILITY IS LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW.

11. Indemnity

You will defend and indemnify Pima LLC and its affiliates against any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising from your use of the Service, your content, or your violation of these Terms, to the extent permitted by law.

12. Termination

You may stop using the Service at any time. We may suspend or terminate access if you violate these Terms or if we must do so to comply with law or protect the Service. Provisions that reasonably should continue after you stop using the Service will survive, including those relating to intellectual property, disclaimers, limitations of liability, indemnity, governing law, and dispute resolution.

13. Export and sanctions

You may not use or export the Service in violation of U.S. or other applicable export laws or sanctions.

14. Governing law and disputes

These Terms are governed by the laws of the state in which Pima LLC is organized, without regard to conflict-of-law principles, except where mandatory consumer protection laws of your place of residence apply.

Subject to applicable law, you and we agree that courts in that state have exclusive jurisdiction over disputes arising from these Terms or the Service, unless a different forum is required by law.

15. Changes

We may update these Terms from time to time. We will post the updated Terms in the app or at https://pima.build/terms and update the “Last updated” date. Continued use after the effective date may constitute acceptance where permitted by law. If you do not agree, stop using the Service.
